Facility Use Guidelines
In use of any Waters Edge facility you may be charged a fee. Fees will vary based on the number of staff needed to work the event, the spaces used, and the time of the event. Fees will be presented to you in a signed contractual agreement. All fees will be payable to Waters Edge Church in cash, or by certified check a minimum of 7 days prior to the event. Failure to present payment 7 days in advance could result in the cancellation of the users event.
Users will not use WEC premises for any unlawful purposes, and will obey all laws, rules, regulations of all governmental authorities while using a WEC facility.
The use of alcohol and drugs is strictly prohibited on WEC premises. Smoking and vaping are not allowed inside any WEC facilities.
Users agree that it will not use the premises for any purpose that is contrary to the mission, purpose or belief of WEC, which is a biblically-based religious institution. User agrees to only use the premises for the intention listed on the signed contractual agreement.
If User is an ORGANIZATION, such organization promises and warrants that it carries liability insurance with a minimum liability occurrence limit of $1,000,000. The User will provide a certificate of insurance to WEC at least 14 days prior to the date upon which the User begins to use the WEC facility. The certificate of insurance will indicate that the User has made WEC an “additional insured” on User’s policy with respect to the use by User of the described premises.
If User is an INDIVIDUAL: If the use of the premises is for minors, User will obtain the signature of at least one parent or legal guardian on an activity participation agreement form acceptable to WEC for each minor participant. No fewer than 2 adults must be present at all times during any program or event involving children. Adults must be 21 or older and must be at least 5 years older than the children they are supervising.
User agrees to hold harmless, indemnify and defend WEC (including WEC’s agents, employees, and representatives) from any and all liability for injury or damage including, but not limited to, bodily injury, personal injury, emotional injury, or property damage which may result from any person using the described premises, its entrances and exits, and surrounding areas, for User’s purposes, regardless of whether such injury or damage results from the negligence of WEC (including WEC’s agents, employees and representatives) or otherwise.
All persons and/or groups using our facilities are expected to exercise reasonable care and judgement in order to prevent defacement, damage, or breakage. The person/s signing the Facilities Use Agreement shall be responsible for paying costs incurred by WEC for cleaning, repairing, etc., any part of the building or its furnishings and equipment, which in the judgement of WEC’s administration has been carelessly or irresponsibly subjected to more than normal wear and tear by the persons or group involved.
User agrees to be responsible for preparing for use and returning to the pre-use condition all areas of the premises which User will use, including entrances and exits. Any decorations must be approved in advance. Room set up changes are subject to approval by WEC and additional charges may apply.
This agreement may be cancelled unilaterally by either party with 14 days written notice to the other party.
In the event that WEC must cancel this agreement, User will be entitled to any fees User has paid. However, in no event will WEC be liable to User for any lost profits or incidental, indirect, special, or consequential damages arising out of User’s inability to use the above described premises, even if WEC has been advised of the possibility of such damages.
User agrees that it will not assign any of its rights under this agreement, and any such assignment will void this agreement at the sole option of WEC.
WEC and User agree that any disputes arising under this agreement will be resolved via a mutually acceptable alternative dispute resolution process. If WEC and User cannot mutually agree upon such a process, the dispute will be submitted to a three-member arbitration panel of the American Arbitration Association for final resolution.
